Migration Agents
You may lodge your visa application through a migration agent. A migration agent is someone who can assist you to lodge a visa application and communicate with Australia’s Department of Immigration and Citizenship (DIAC) on your behalf – usually for a fee.
You do not need to use a migration agent to lodge a visa application. However, if you do not feel confident in lodging an application, or if your case is complex, you may wish to use a migration agent to:
• advise on what visa may best suit you
• tell you what documents you will need for your application
• help you fill out the application form; and
• submit the application and communicate with DIAC on your behalf.
Migration agents operating in Australia are required by law to be registered with the Migration Agents Registration Authority (MARA). Offshore agents currently do not need to be registered, however, DIAC still recommends using a registered agent where possible.
You can find a registered agent by looking on the MARA Website at www.themara.com.au. Check if the agent you are considering using is on the lists before making contact.
Using a registered agent will help ensure that you receive a professional service as all registered agents are required to:
• provide you with written advice about the fee they will charge and the service they will provide;
• maintain a sound knowledge of migration law and procedure;
• act professionally and in a timely manner; and
• abide by the Migration Agents’ Code of Conduct.
Registered agents should not:
• engage in false or misleading advertising - including guaranteeing the success of an application;
• imply a relationship with DIAC;
• act if a conflict of interest exists; or
• intimidate or coerce clients.
If you receive an unprofessional service from a registered migration agent, you should complain to the MARA, by using the complaint form available on their website.
We once again stress that using the services of a migration agent remains at your discretion.
