CHILD MIGRATION

Who is this visa for?
Applications may be made at the Australian Embassy Moscow for any of the following visa subclasses;
Child (Subclass 101)
For children from overseas who are natural, adopted or step children of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
Adoption (Subclass 102)
For children from overseas who have been or about to be adopted by an Australian citizen, the holder of an Australian permanent visa, or an eligible New Zealand citizen.
Important: If the child was adopted before the parent became an Australian citizen, the holder of an Australian permanent visa, or an eligible New Zealand citizen they cannot apply for this visa. They must apply for a Child visa (subclass 101).
Orphan Relative (Subclass 117)
For children from overseas whose parents are deceased, permanently incapacitated, or whose whereabouts are unknown and who have an eligible sponsor.
Extended Eligibility Dependent Child (Subclass 445)
For children whose parent holds a temporary partner visa and is in the process of obtaining a permanent partner visa.

General processing information
On the day we receive your application with a valid receipt of payment, we create a new file to hold the application and other information/correspondence which we may receive during processing. We will provide you with a letter acknowledging receipt of your application and advising you of:
• your file number,
• the name and contact telephone number of your case officer,
• additional documentation and/or evidence required,
• usual processing time, and
• (if appropriate, usually if the applicant is over 18 years of age) the time, date and location of your face-to-face interview with an Immigration Officer. Applicants to be interviewed in centres other than Moscow may receive an approximate timeframe for the next interview trip only.
Please note: where the application has been mailed, the acknowledgment letter will be sent to you within 7 days. We always try to communicate with you by the fastest means. If you have an e-mail address or fax we can use, please note this in the application form so we can communicate with you electronically.
If you have nominated another person to receive written communications on your behalf, we will send this information to that person.
Interviews
As part of the assessment process, applicants over 18 years of age may be required to attend an interview with an Immigration Officer. A decision on whether an interview is required is based on the circumstances of each case and not all applicants will be interviewed.
The sole purpose of these interviews is to gather information on whether the applicants meet the criteria for the class of visa they have applied for. Interviews are conducted in Russian or English. If you wish to be interviewed in a language other than Russian or English please advise us prior to lodgement of your application. Interviews are conducted regularly in Moscow. In addition, representatives of the Immigration and Visa Section travel to Ukraine approximately every three months to conduct interviews. Interviews may also be conducted in Vladivostok or other locations if there is sufficient interest from applicants; however, these will occur more rarely. Applicants will be contacted if and when these opportunities arise.
Applicants who prefer to be interviewed in either of these locations are advised of the date and time of the interview approximately 2 – 4 weeks beforehand.

The following are lists of documents which should be submitted when you apply for this visa.
For Child visa (Subclass 101), Adoption (Subclass 102) and Orphan Relative (Subclass 117)
o form 47CH signed by the applicant (or their responsible guardian), with all questions answered. For copies of the 47CH form please visit the DIAC website;

If there is more than one child, they must each complete an application form (47CH) but only one fee is payable if the applications are lodged together.
o 4 recent passport size photographs of each applicant;
o Evidence that the sponsor is an Australian citizen or Australian permanent resident (eg Australian citizenship certificate or copy of passport pages that show identification page, permanent visa and any arrival/departure stamps for Australia);
o the child's Birth Certificate
o Police certificates for all people included in the application who are 16 years of age or older. Police certificates are required from every country you resided in for 12 months or more (in total) during the last 10 years. Please, provide the original document; certified copies of police certificates are not acceptable. More information about obtaining police certificates can be found in Form 47P.

Additional requirements for Child visas:
o If the applicant is 18 years of age or over
• evidence of financial dependency on the sponsor, including receipts of financial remittances over a substantial period; and/or
• evidence of continuing and current enrolment in studies (High School and College/University transcripts and/or certificates verifying current enrolment at current school); and
• evidence of contact between the applicant and the sponsor.
Additional requirements for Adoption visas:
o Evidence that adoption process has been completed;
o Letter from Australian State and Territory adoption agency, if applicable.
Additional requirements for Orphan relative visas
o Birth certificate of the sponsor and evidence to establish the relationship between the child and the sponsor;
o Death certificates of child’s parents or evidence that the child’s parents are permanently incapacitated to care for the child eg specialist reports, court documents
For Dependent Child Visa (Subclass 445)
o form 918 signed by the applicant (or their responsible guardian) and the sponsor, with all questions answered. For copies of the 918 form please visit the DIAC website;

If there is more than one child, they must each complete an application form (918) but only one fee is payable if the applications are lodged together.
o 4 recent passport photographs of each applicant;
o the child’s Birth Certificate;
o evidence that parent of the applicant holds one of the following visas:
• Partner (Temporary) (Class UK) Subclasses 820 and 826;
• Partner (Provisional) (Class UF) Subclasses 309 and 310; and
• Extended Eligibility (Temporary) (Class TK) Subclass 445.
NOTE – If the parent already holds a permanent visa, (eg: Subclass 100 or 801) this is NOT the correct visa subclass for your child. Refer to Child Migration (Subclass 101).
o evidence that the sponsor is an Australian citizen or Australian permanent resident (eg Australian citizenship certificate or copy of passport pages that show identification page, permanent visa and any arrival/departure stamps for Australia);
o If the applicant is 18 years of age or over
• evidence of financial dependency on the sponsor, including receipts of financial remittances over a substantial period; and/or

Processing Times
The average processing times for Child Visa applications lodged in Moscow is 8 weeks. Applications should be lodged as early as possible before any planned travel to Australia.
